[In the left margin] Cofield[sic] to Nicholson This Indenture made the 8th day of January in the year 1808 between Graham Coffield on the county of Southampton of the one part and Seth Nicholson of the aforesaid county of the Second part and Benjamin Lewis of the said county of the third part. Witnesseth that whereas the Graham Coffield stands justly indebted it to the said Seth Nicholson in the just and full sum for of eighty pounds thirteen shilling and 11 3/4 and will appear by his bond bearing date eight of January 180eight and due June the eight eighteen hundred and nine and being desirous to secure the payment of the sum aforesaid and legal interest that may accrue thereon it is a agreed I just said Graham Coffield and Stith Nicholson the cash Convayance[sic] and trust shall be made to the said Benjamin Lewis for the benefit of the said Stith Nicholson in care the sum money or money aforesaid shall not be paid when due now this indenture therefore witnesseth that the said Graham Coffield and in consideration of the premises aforesaid and for the further consideration of the sum of one dollar to him and in hand paid for the receipt whereof is hereby acknowledged at hath granted, bargained and sold aliened effossed released and confirmed and by there presents doth for himself his heirs executors and administrators grant bargain and sell alien make over and confirm unto send Benjamin Lewis and his heirs executor administrators and assigns one certain tract of land Situate lying and being in the county of Southampton containing by estimation five and three fourths acres be the same more or less and bounded as follows to wit Beginning at a corner in Charles B Nicholson line thence along his line to the beginning and all the estate right title and interest of him just said Graham Coffield of in and to the said tract of land and appurtenances to have and to hold the said tract of land and premises with the appurtenances to the aforesaid Benjamin Lewis his heirs and assigns forever and the said Graham Coffield for and consideration of the premises as above mentioned hath granted bargained and sold by these presents doth grant bargain and sell make over and confirm unto the said Benjamin Lewis his heirs executors administrators and assigns the following property to wit one bay mare two featherbeds furniture one black one comb and harness shoop and tools one iron Pot tea kittle[sic] dutch oven one pair skillet & one spinning wheel and every pieces of property whatsoever Belonging to the said Graham Coffield Inrnist?, nevertheless and upon this express Continues on the next page Names appearing on this page incluse: Benjamin Barham; Graham Coffield; Benjamin Lewis; Robert Millar; John Nicholson; Stith Nicholson; provise that if they said Stith Nicholson his executors or administrators shall punctually pay or cause to be paid unto the said Stith Nicholson or to his his executors administrators or assigns the aforesaid sum of eighty five pounds thirteen shillings and eleven pence three farthings and the lawful interest that may accrue thereon then the said Benjamin Lewis shall execute proper and legal release for the property hereby conveyed, but it is agreed by the parties, and it is declared to be true intent and meaning of the parties to these presents and the said Stith Nicholson doth coverant and agree with the other parties hereby, that in case they said Graham Coffield his heirs executors and administrators shall failed to make payment of the debt and interest aforesaid when due, but then the said Benjamin Lewis, his His executors administrators or assigns Shall at the request of the said Stith Nicholson, his heirs executors and administrators, at any time after the eighth day of June in the year of our Lord eighteen hundred and nine aafter giving due notice not less than 20 days sell at public sale the aforesaid property or so much thereof as shall be sufficient to discharge the debt and interest aforesaid or what may be then do, together with the expenses arising from the notice and sale all other reasonable and contingent charges hereof, and shall pay the money arising from the sale to the said Stith Nicholson, his heirs executors and administrators or so much as may be due and owing after satisfying the debt and cost aforesaid and Shall pay the surplus money to the said Graham Coffield his heirs executors administrators or assigns. it is hereby agreed on an understood by and between the parties to these presents, the the land above granted is not to be sold until all the rest of the property granted, is sold, and found insufficient to pay the debt and costs aforesaid.
